Subject: PF form clearance

resigned without giving notice period. company is not signing my PF form for withdrawal.what can i do??

Company by any chance cannot hold the PF of any employee. You have 2 options with you.

1. You can continue with the PF account with your new employer. All you have to do is update your new employer with the pf a/c no. 2. if you still wish to withdraw your PF money, send a letter through registered AD asking your employer to sign on the PF form with Stamp. This will serve as a legal proof. Nowadays the labour court is easily accessible. You can approach them and file a petition against your old employer.(I am sure, he will be royally jacked).

Under no circumstances, a company cannot deny on signing on PF Form. Send them one legal notice, your work will be done much faster.

Dear Sir, for resigning without giving notice period ( if the offer letter says so) you may have to pay your salary amount ( 1 month or 2 or three as per offer letter). Since u would not have paid this amount they may be adopting this tactics.Better talk to them and find out what u owe on account of notice period and pay and get their signature. In the mean time u meet the PF Commissioner and explain the situation and take his views. As PF is your earnings and to be given to u with interest , attachement is difficult.- rajaram

Shaz,

If you have completed your 3 Months periods leaving the Company, you can request the PF Withdrawl directly from the Office of PF Commissioner.

Instead of getting it attested by your Drawing officer have the same attested by a Gazzeted officer Known to me.

the first thing just get form 19 c and 10 c and fill all the details and write a letter to pro officer in your city instead of company signiture you can get any bank manager signature or a gessate officer signature and then you can directly claim your pf without your company signature
