1. Scope of these Terms and Conditions

These terms and conditions govern all use of the Ask Agent™ network, including Ammas.com, AnswerPod.com, and any other website which users the Ask Agent™ technology. We hereafter referred to this network as the "Network" and to Ammas.com Ltd as "Ammas."

Ammas may, at its complete discretion, add to, delete, or modify these Terms and Conditions without notice. By either using or registering as a Member or visitor with the Network, you agree to use the Network in a manner consistent with all applicable national, local, state and federal laws and regulations and in accordance with the Terms and Conditions discussed below.

2. Limitations in Use

You agree that you use the Network entirely at your own risk and that Ammas is not responsible for any outcome resulting from your use of the Network, including but not limited to any failure of performance, error, omission, interruption, defect or computer virus, or the deletion, failure to store, failed delivery or unavailability of any information, material, products, services, applications or features, even if advised of the possibility of such damages or losses.

Though Ammas will do its best to store all data appropriately, Ammas makes no implied or express representation or warranties about the reliability, or accessibility of the Member Pages, information or the associated storage facilities. Ammas is not responsible for any damage caused by loss of access to, deletion of, failure to store, failure to back up, or alteration of Members Home Pages and data. Individual members are responsible for monitoring and creating backups of their information.

The maximum liability to you for all claims made against Ammas, including but not limited to negligence, shall in no event exceed the amount you paid to Ammas to access this Network. By using the Network, you agree to release and hold harmless Ammas, its affiliates, officers, directors and employees from any and all claims, demands, damages, costs and expenses of any kind whatsoever relating in any way to use of the Network.

Ammas reserves the right to delete any content at any time at its complete discretion.

a) Membership is available to anyone over the age of 13 who registers and accurately provides all the required information, including a legitimate electronic mail address and who obtains a unique Network Member Name and password. Membership is non-transferable. Ammas does not discriminate on the basis of age, gender, race, ethnicity, nationality, religion, or sexual orientation. Children under the age of 13 may only register with the express consent of a parent or guardian.

b) Ammas allows one Membership per individual with a legitimate electronic mail address.

c) Please be courteous when selecting your Network Member Name. Ammas does not permit the use of vulgar or offensive language as Member Name. You may not use the name of any individual, entity or organization, or any term that is a trademark, service mark, or copyright, or that violates any other proprietary right held by another. Ammas may, at its discretion and without notice, delete or revoke any Membership associated with a Member Name of this nature.

d) Ammas may terminate any Membership (and any and all related information, communications, postings, or Web pages) at any time, without notice, for conduct that violates international, local, state or federal laws or regulations, these Terms and Conditions or other policies or guidelines set out by Ammas elsewhere on the Network, or for material that Ammas in its sole discretion believes is harmful to other Members, the business of Ammas, or other third-party information providers. Individuals who have had their Memberships terminated may not continue to utilize member privileges in any manner or for any reason without the express written permission of Ammas.

4. Public Communication

Ammas offers its Members the ability to communicate on-line through the website and email. It is the intention of Ammas to allow open and diverse communication through the use of these systems. Conduct in these areas is governed by the guidelines set forth in Section 2 of this document and the separate terms of service of each of those services. But Ammas does not guarantee that these guidelines will be followed and, therefore, expressly disclaims any and all liability arising from or relating to any failure to follow such guidelines.

The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Network, including Ammas.com, Ask Amma, the AnswerPod, and Ask Agent™ are Trademarks of Ammas. All other Trademarks, publicity rights and other rights are the property of their respective owners. You do not have any license or right, by implication, estoppel, or otherwise, to use any Trademark, image or other material displayed on the Network without the written permission of Ammas.com or the third party that may own the relevant material.

You agree that in publishing information on the Network, you will share the copyright for the information with Ammas, which means that you cannot republish or resubmit the information to any other media source without the express written permission of Ammas. Ammas will not infringe upon your own copyrights over the information, but you agree that Ammas may modify the information for use in a variety of media and applications. If you object to any modification(s), you may send an email to info@ammas.com and request to have your name removed from the information.

Ammas right to use your information is royalty-free (that is, without payment to you), and extends to all media, whether now existing or later discovered, including but not limited to print, film, and electronic (not limited to our website). This permission is non-exclusive, permanent, irrevocable and has worldwide application.

8. Reporting a Violation of these Terms and Conditions

If you witness a violation of these guidelines, please notify us at legal@ammas.com. Ammas will respond as quickly as practical to any such claims, but undertakes that it is under no obligation to act or not act with regards to any complaint. Any action taken will be at the sole discretion of Ammas.

It is the policy of Ammas to respond quickly to claims of all intellectual property infringement. Ammas warrants that it will promptly process and investigate all notices of any alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws. Upon receipt of notices complying or substantially complying with the DMCA, Ammas will act expeditiously to remove or disable access to any material claimed to be infringing or claimed to be the subject of infringing activity and will act expeditiously to remove or disable access to any reference or link to material or activity that is claimed to be infringing. Ammas will terminate access for subscribers and account holders who are repeat infringers. Notices of claimed infringement should be directed to:

When Ammas removes or disables access to any material claimed to be infringing, Ammas may attempt to contact the user who has posted such material in order to give that user an opportunity to respond to the notification, although Ammas makes no constructive representation to do so. Any and all counter notifications submitted by the user will be furnished to the complaining party. Ammas will give the complaining party an opportunity to seek judicial relief at their own cost in accordance with the DMCA before Ammas replaces or restores access to any material as a result of any counter notification.

If Ammas becomes aware of the presence of material on its server(s) that violates any other right of any party, either in the course of its ordinary and reasonable business activities, or through notification by a third party of the specific location of the alleged presence of such materials, Ammas will contact the member responsible for the material and alert him or her of the allegations, requiring that within five days he or she must respond as to why the material does not violate the rights in question. Ammas also will alert the Member that, absent such a response, Ammas reserves the complete right to delete the Member Home Page and account information; and, if the member fails to respond within five days, Ammas will make a decision whether to remove the Member Home Page and account information. In all cases, if in its sole and absolute discretion, Ammas concludes that one of the Member Home Pages violates the rights of any other party, Ammas reserves the right to delete the offending Member Home Page and account information at any time without prior notice.

9. Violations

Ammas reserves the right to pursue any and all legal and equitable remedies against anyone violating these Terms and Conditions, including but not limited to terminating membership. Any failure by Ammas to enforce any of its rights hereunder shall not be deemed a waiver of such rights or of any other rights.

Each Contributor or Member agrees to indemnify Ammas and any third-party content provider against any and all claims and expenses, including legal fees, arising from the Member's use and/or misuse of the Network. This includes, without limitation:

Member's responsibility for any and all liability arising from the violation or infringement of proprietary rights, copyrights, trademarks, or servicemarks and Member's responsibility for any and all liability arising from any libelous or unlawful material contained within Member Home Pages. By using the Network you are hereby agreeing to release Ammas and its affiliates, officers, directors, and employees from any and all claims, demands, debts, obligations, damages (actual or consequential), costs, and expenses of any kind or nature whatsoever, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that you may have against them arising out of or in any way related to such disputes and/or to the products and services of Ammas.com. You hereby agree to waive all laws that may limit the efficacy of such releases.

These Terms of Service constitute the entire agreement between the parties with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between Ammas representatives and each Member with respect to the subject matter hereof. Ammas may amend these Terms of Service at any time without notice.

12. Parental Controls

The business of Ammas is in no way associated with material that may be offensive or harmful to children. However, because of the size and variety of the Network, and the amount of data submitted to the Network, we cannot regulate every piece of data and guarantee that all the material on the Network is suitable for minors. As with any other Internet site, we strongly encourage parental guidance for children under the age of 13.
