Question:  NAMASKAR. Subject:  Refund of money
Question:  I paid 4 lacs as the margin amount to the owner for a flat in Mumbai and remaining amount was supposed to be paid by me by way of bank-loan. However, I found that the valuation of the property according to the bank is low and I cannot make additional margin amount payment to the owner. We have already made an aggreement for sale for this flat and the partial payment by me (4 lacs) was also mentioned in that agreement which I paid through two cheques to the owner. The remaining amount which I was supposed to pay to the owner was mentioned in the sale agreement however the date field was left blank. This sale agreement was registered along with the stamp duty charges. Now as I couldn't get sufficient funds from the bank (Loan), I want to cancel this deal. But the owner is refusing to pay my money back (3.5 lacs). Can the owner cancel this sale agreement without paying my money back OR without my intervention ?? Can the owner sell/lease/rent the flat to someone else without cancelling this sale ageement ?? Please help me what should I do to get my money back. Thanks in advance.
