Subject:  Disputed will
Question:  I am married for 4 years. We are 4 members in a family,me my husband,my FIL & my MIL.The problem is the house we live in was bought 30 years ago by my FIL but because he was a govt servant at that time he could not show his income so he bought the house in the name of his father. My FIL has a younger brother married with 3 kids. They used to stay togther but from the last 12 years they have been staying on first floor which was built later after the fightings started between my MIL and my FIL younger brother wife.We have one main door for which there are 2 keys given to both the brothers and also there is provision of seperate entrance. This lady is very smart and is really in good books of her FIL.My MIL & FIL are very sweet, docile. Now my FIL's father has made a will which says that ground floor and half the terrace is my FIL property and first floor and the other half terrace is my FIL brother property. The problem is that in that will it is also written that we cannot sell the ground floor,if we sell it it will be given to the younger brother. The will is registered and nothing can be done.We even cannot give it on rent.We cannot leave the property also since it is worth lacs. The problem is we really want to sell the house beacuse the place we live is very dirty, roads are very narrow, parking is a big problem,no fresh air,no playground/park for children. Pls take note that we cannot even talk abt all this to my FIL's father otherwise he might change the will all togther. We also cannot leave my MIL and my FIL alone... Pls advice ASAP.. Thanks SB India

Until your father in law'father dies the will does not come into effect.

The main issue comes in that you only have a single entrance and house that has been split into two rather than two separat

If the will stands as is, and you FILs father were to pass away, the property will be divided into half (as explained). I am surprised at the clause that says, you cannot rent your portion - as far as

Question:  Dear ammas, Thanks for doing this wonderful job. You have always helped me. I am permanent resident here, having 3 yr old son (US Citizen), and want divorce from my citizen husband. I am looking for some answers before taking any step- 1) My husband sponsored my green-card that I received in Jan, 2004. Will my green-card be safe and out of danger as I have already completed 2 years? If I get divorce now, can I still be eligible to apply for citizenship? That I guess, I would be able to apply after 3 yrs of getting the green-card). 2) Will I have any problem to get my son's custody? I don't want to loose him. I am economically independent. 3) In future, if I want to sponsor someone (as my husband), can I do that with my permanent resident ship? Thank you.....
